News \ Nintendo wants the USA to stop those Pirates

Videogame Piracy continues to get worse and destroy the industry the we the gamers love so dearly and Nintendo, who were more so immune to its effects last generation with its hard to pirate Gamecube disc, want to do something about it. Modchips such as the WiiKey are now easy to obtain and are legal in places like Australia, to counter these (chips) Microsoft bans users permanently off its popular online Xbox Live service if they are caught using a modded console while the PS3 uses its its exclusive format of Blu-ray giving it the advantage that the Gamecube had last generation. Nintendo's US office have asked the US trade representative to try to convince governments to take a harsher stance on the issue of piracy.

Nintendo sees China as the main problem when it comes to countries pirating games but now also sees Korea, Brazil, Hong Kong, Paraguay and Mexico as threats.

Jodi Daugherty, Nintendo of America's senior director of anti-piracy said "The unprecedented momentum enjoyed by Nintendo DS and Wii makes Nintendo an attractive target for counterfeiters, "We estimate that in 2007, Nintendo, together with its publishers and developers, suffered nearly $975 million USD worldwide in lost sales as a result of piracy. Nintendo will continue to work with governments around the world to aggressively curtail this illegal activity."

Nintendo released the following statements of piracy in certain areas

• Worldwide overal: Nintendo recommends stronger laws in all countries against the circumvention of technological security measures. Video game pirates have developed DS game-copying devices and modification chips to target the security found in Nintendo's hardware systems and allow the play of counterfeit software or games illegally downloaded via the Internet.

• Chine: China must pursue criminal prosecutions against people involved in large-scale piracy operations. Nintendo works with Chinese authorities, who seized more than 1 million fake Nintendo products in China during the past year. But not one counterfeiter has been prosecuted.

• Korea: Nintendo supports the Korea-U.S. Free Trade Agreement, but suggests that it must be ratified immediately to address service providers who are profiting from the uploading and downloading of illegal Nintendo content. Korea is an important market for Nintendo, and Internet piracy is seriously affecting the growth of the video game industry in the country.

• Central and South America : Latin America remains a haven for piracy. Evidence supporting this claim includes escalated violence in Mexico against police conducting anti-piracy raids, extraordinarily high tariffs and taxes placed on the sale of authentic video games in Brazil and widespread corruption in Paraguay. During the past year, Nintendo assisted local authorities with more than 65 actions that resulted in the seizure of approximately 230,000 counterfeit Nintendo games in Brazil, Mexico and Paraguay alone. Despite Nintendo's efforts, the piracy levels continued to rise. Nintendo is calling for significant changes to laws and to the enforcement regimes in those countries.



Videogame Piracy has been a problem for many generations through the use of modchipping. Nintendo in the past have not had to worry as much due to using cartridge based systems and then the smaller Gamecube disc but now for the first time with the Wii have to suffer the ill-effects of the pirates out there, in the end all you are really burning is the industry.

If anyone believes piracy is a positive thing, then let a stranger copy your work whether it be a school essay, report at work, piece of hard work, etc and be happy that you have been robbed.

If this were a bank that lost this money but still made over 2.4 billion profit from you would you care? Most with a mortgage would say NO. Well whats the difference, they are both company's.

You will probably find that the loss of sales probably helped with the rise in sales. How can this be you may ask! Well think of it like this. My son has an original Pokemon Diamond DS cartridge. He nags me for weeks to get him Pokemon Perl. I say NO because I think its the same game in a different rapper. He tells me its not the same, what do I do.

I pirate the game by putting it on my flash cart for the week end and give him my flash cart to play Perl. He comes back on the Sunday evening and explains all the differences between Perl and Diamond. So on the Monday I go out and buy him Perl and delete it off my flash cart. As you see, my download goes toward the loss but has now contributed to the gain.

Microsoft has recognized this and has turned a blind eye to some piracy as they know they will get a gain else where by people either buying a legit copy of Windows or by buying a legit copy of Office etc to run on their pirated Windows.

Look at the open source community. They give away a stack of their software, how do they make money?. Well the bugs are ironed out by users of the free package and then they sell the enterprise package bug free. They could technically call the free downloads lost sales but these lost sales make them money.

That would be why the PS2 was the best selling "last-generation" console: it was dead easy to pirate with it. Plus you could play all the PS1 titles as well, no wonder they sold more consoles in certain countries then titles.

Plus the price structure that is currently used by manufacturers leaves themselves with some of the blame.

I realise that there are substantial costs involved with creating, testing, manufacturing and distributing games, but for most people, they will never get to enjoy the vast amount of games available due to cost.

I'm still waiting to see a players choice title become available for either DS or Wii consoles.

This is in no way an endorsement for piracy, but I can see why people do it.

I'm one of those people that has to buy my games, as I NEED Nintendo to keep making Zelda titles.

When the Gameboy Advance was out, piracy was even more prevalent since the cost of producing fakes was so cheap.

The DS cartridge is a just a little bit more expensive for pirate manufacturers.

Indeed they are. But I don't think some people are smart enough to think about it like that. They're thinking of the short term from their wallets perspective. A rather selfish a short sighted view on things.

yep, and even still with cartridges, the ds is easy to pirate.

That 975 Million was lost sales and not net profit. sales for the last 9 months of 2007 were 12 Billion.

This is only a small percentage.

There's nothing wrong with mod chips if they're only used for playing imports. That's the only reason I would have one on any of my consoles.

It's not enough to just blame the people who make such things though.
People are going to pirate games and movies as long as there's a demand for them.
If people spent that little extra for the genuine thing there wouldn't be a problem.
In the end it us, the consumer who miss out.
If developers don't get the money from the games they work so hard to make, then they won't want to make any more.
Not that I have to explain this to everyone, right?

Anyway, great article (I mean it's well written, not that the subject of the news is great ).
