Flash Cartridge Description:

Flash cartridges are special game cartridges that can hold custom data, usually in the form of built-in memory or memory cards like SD and Micro SD. These devices can be used in a Nintendo DS or Gameboy Advance to play video, listen to music, run Homebrew software and play Homebrew games.

You are wrong about that it is not illegal. What is illegal though is putting commercial game roms onto the card.
